ACCEPTANCE OF TERMS & CONDITIONS

These Terms & Conditions administer your utilization of the GameFlame website (www.gameflame.pk). By using, visiting, downloading, browsing, or installing any portion of the GameFlame site and services you accept and agree to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions, you should not subscribe to any GameFlame package.

CHANGES TO TERMS & CONDITIONS

GameFlame provides the GameFlame Site and Services to you subject to the following Terms & Conditions which may be updated occasionally, at our sole discretion, with or without notice to you. The most current version of these Terms of Use will always be on this page and will replace all previous versions. There will always be a link to the most current Terms & Conditions on the www.gameflame.pk homepage.

We reserve the right, in our sole and absolute discretion, to change, modify, add or remove portions of these Terms of Use from time to time (with or without notice). Your continued use of the GameFlame Site and Services, or any portion thereof, after changes are posted, means that you accept and agree to be bound by such changes. As such, it is your responsibility to review the Terms of Use periodically.

RENTING OF GAMES
Minimum Requirement

By joining this service, you confirm that you meet the following minimum requirements. GameFlame reserves the right to cancel anyone’s membership where we suspect that you do not meet these requirements.

  1. You must be at least 18 years of age. INDIVIDUALS UNDER THE AGE OF 18 MAY UTILIZE THE GAMEFLAME SERVICES; THEY MAY DO SO ONLY UNDER THE SUPERVISION AND WITH THE CONSENT OF A PARENT OR LEGAL GUARDIAN. If you are under 18 (or equivalent minimum age in the relevant jurisdiction), you must review this Agreement with your parent or legal guardian to confirm that you and your parent or legal guardian understand and agree with the terms of this Agreement. 

  2. You must live in Pakistan

  3. You agree to provide us with personal details (including your name, email address, address and contact number) that are true and current, and you agree to update us if at any time your personal details change.

Membership and Billing

By providing your contact details to GameFlame you agree to receive notifications, offers, alerts, etc. unless you tell us not to. However, invoice notices or any other information that GameFlame deems necessary to provide to you will be provided to you, with or without your consent.  These communications are also part of your subscription to our Service. Regarding billing, any amount that is due on you will be sent an invoice containing all of the details of the dues. After the payment of the dues, a ‘Paid Invoice’ will be sent to you containing all of the details of your payment. By subscribing to us you acknowledge that the game that you receive may or may not meet your expectations and might necessarily not have the content that you expected it to have. Games may or may not have their DLC, and the cover of the games on the discs provided or on the images in the website does not necessarily indicate the content that you will receive in a game.

Your Service will continue in effect unless and until you properly cancel your membership or we terminate it. By joining the Service, you expressly agree that we are permitted to charge you on a monthly/6 month/ or annual basis (depending on the plan chosen) the subscription fee at the then-current rate (plus any applicable taxes) and any other charges you may incur in connection with your use of the Service. The subscription fee will be billed in full on the first day of your paid subscription and on each monthly/6 month/annual anniversary thereafter, unless and until you cancel your subscription. If membership is not cancelled within 5 days after the start of the new billing cycle, the new month is charged. Non-payment after that will result in deduction from the security deposits.

ANY PAYMENTS OTHER THAN THE SECURITY DEPOSIT ARE NON-REFUNDABLE AND WE DO NOT GIVE REFUNDS IF CANCELLATION IS INITIATED AFTER 5 DAYS OF START OF A BILLING CYCLE, OR IN ANY OTHER CASE WHATSOEVER. We also reserve the right to change our fees and prices at any time, or add new fees and charges from time to time. In the case where we do not receive the outstanding subscription charges and/or Video Games, after or during a membership, GameFlame reserves the right to cut the due amount from the security deposit provided by you. Non-payment for 2 or more consecutive months may lead to cancellation of membership from GameFlame without notice and the due amount being deducted from the security deposit.

For the security deposit the member can either pay full security deposit i.e. 8400 or 4800, based on the number of discs provided in a package, or a member can avail our security deposit offer where they can pay either 6400 or 3200, again based on the number of discs provided in a package. The difference is that in the full security deposit the member gets access to 100% of the game library, whereas in the security deposit offer the members get access to 90% of the game library and not to 'expensive games'. Expensive games generally refers to new games but that is not usually the case. The definition of and whichever games are included in the definition of 'Expensive Games' is solely up to GameFlame.

Subscription Changes

You may upgrade or downgrade your GameFlame subscription as often as you like by contacting and requesting from us at least 5 days prior to the start of your next billing period. Any reduction in your monthly bill will take effect at the next billing period after any outstanding games have been returned to us. In the result of a downgrade, no amount will be refunded in the running billing period. In the case of a request of an upgrade of your package, the upgrade will take place in the start of the coming billing period and the current package and plan will remain until the end of the current billing period.

Delivery Policies

The delivery process will be initiated as soon as we receive a confirmation from you about your game choice, which will be inquired by us. The delivery of any game is subject to its availability. The delivery may take up to 3 days; however, actual delivery times may vary for you depending on (i) our stock availability, (ii) your delivery address, (iii) when you make your selection; we might not operate on certain days, however, you will be notified in advance. And (iv) other circumstances impacting delivery.

For any delivery outside of Karachi: The game will be sent from Karachi on the expense of GameFlame only if the Free Deliveries of the customer is remaining. After the Free Deliveries, delivery charges will have to paid by the customers for both ways, i.e. when GameFlame is sending the game from Karachi and when the game is being resent from another city. Any damage to the game when en-route from Karachi to the customer should be reported to GameFlame by the customer not a day after receiving the game. If GameFlame receives no such report, it will be assumed that the customer received the game in the same condition in which it was sent.

 

The games being resent to us at Karachi, from any location will be always done at the expense of the customer. PLEASE NOTE that games received back without any sort of a cover whether bubble wrap or cardboard, the members will be charged an additional Rs. 100. And it is solely the responsibility of that customer to ensure that the game is properly packed when sending the game back so that we receive the game in the same condition in which it was sent. For any kind of damage to the disc or cover of the game during the process of the game being resent to us to Karachi the customer will have to reimburse GameFlame. The reimbursement amount will be determined solely by GameFlame depending on the condition of the package, disc, etc. PLEASE NOTE that if a FREE Delivery(ies) of a month is not used by a member, it DOES NOT accumulate with the coming month's FREE Delivery(ies). 

Game Condition

You agree to treat the games and their associated packaging with the utmost care at all times. All and any games that you receive have been checked prior to being sent to you, this means that any problem found in the game after receiving it back from you will be assumed to be caused by you. This is why you must inform GameFlame of any problem found in the game on the same day of the delivery. Not checking or reporting any problem within this time will mean that you received the game in a workable condition.

 

You agree that you may need to compensate GameFlame for any game lost or if returned in an unacceptable condition (beyond reasonable wear and tear) - and that you allow GameFlame to charge such compensation to the security deposit provided by you, at the market price of a new copy of the damaged game. We will notify you of any such charges. The description of “unacceptable condition” is solely up to GameFlame and usually includes games that are not working because of being damaged, cracked, scratched, burnt, bent, or anything similar.

Reimbursement for damage to games is as follows:

Losing the cover picture= Rs. 150

Losing the disc cover= Rs. 300

Losing the cover picture and disc cover= Rs. 450

Breaking the cover in any way= Rs. 100

Right to Terminate

We reserve the right to terminate or restrict your subscription, or the use of any or all of the GameFlame Site and Services, without notice, for any or no reason. After termination of the subscription, all due amounts will be charged from the security deposit. The price of the game currently held by the customer if not returned or returned in an unworkable condition will also be charged from the security deposit; whatever remaining, of the security deposit, will be refunded back to the customer.

Allocation and Use of Games

You concur that you will be in charge of any utilization of any games provided by us to you and that any minor's utilization of any games will be confined by you consistent with any appropriate age classification connected to that game. Allocation and delivery of games is subject to availability and the procedure of allocation of games, new and old, available and unavailable, is entirely up to GameFlame. A waiting list of any unavailable game is formed by GameFlame, with the procedure of its formation entirely up to GameFlame with no other influence whatsoever of anyone else. However, those with Fire and Magma package will be given priority over others if they ask to get their names written on the same day as those with Ember or Lava package.

 

If Ember or Lava package holders ask to get their names written before that, then the names of those are written, before those with Fire and Magma package on the basis of 'First Come, First Serve.' basis. It is not up to us that when the member gets new games as it is up to the members when they return it. So it may take anywhere from a few days to many months for a member to get hands on a new game depending on the number on the waiting list.

 

Ember and Fire Package holders can get their names written on maximum 3 waiting lists of games. Lava and Magma Package holders can get their names written on maximum 5 waiting lists. A member will be removed from all of the waiting lists with the cancellation of their membership. GameFlame does not have the obligation to hold onto a game for more than a day as a member completes the current game they hold. Members with new games with considerable demand are given a maximum time of 3 months of time to play the game and return it for a chance for others to play. In such a case, the members will be informed by GameFlame for the return of the game. Failure to return the game within 3 months of delivery after notice from GameFlame will result in the member being charged an additional Rs. 400 every month after the 3rd one.

Cancellation

As mentioned earlier, you may request to cancel your subscription to GameFlame at any time. HOWEVER, REQUESTING FOR CANCELLING OF MEMBERSHIP BEFORE 3 MONTHS OF MEMBERSHIP WILL RESULT IN THE MEMBER BEING CHARGED AN ADDITIONAL MONTH. You must cancel your membership before your next billing period. Failing to do so will result in an additional month being charged if 5 days have passed in the new billing period. Cancellation requests must be given to us via any contact method as mentioned on the homepage of our website. No other method is acceptable and GameFlame will have no liability for a cancellation request sent by any other means.

 

For members in Karachi the cancellation process will start as soon as we are informed. For members outside of Karachi the cancellation is NOT initiated until a valid courier service tracking ID of the dispatched game is provided which can be checked on the day the game has been dispatched OR when the game is received. IF either of this is NOT done within 5 days of start of new billing period the member will be charged the new month. Once cancellation has initiated, no more games will be further delivered to you. A representative from GameFlame will visit your place and receive the game of GameFlame from you that you held currently, if in Karachi. Otherwise you will send the game back via courier.

 

No security deposit will be refunded until the game has been checked as being in a working condition in the GameFlame office. If no problems are found, and no dues remain then the security deposit will be refunded accordingly. Member will be removed from all of the waiting lists of games with the cancellation of their membership. Furthermore, for non-karachiite members; if a refund via bank transfer is requested then no additional charges will be upon the members. However, if refund via EasyPaisa/Mobicash or any similar means is requested then the member will be charged Rs. 250.

BUYING GAMES

You may at any time select to buy a game at a discounted rate which you are currently renting. For this, you must contact us and firstly inquire whether it is up for sale or not. Afterwards inform us so that we may collect the fee during our next delivery. The price to pay will be communicated to you by a GameFlame representative from any communication method that you choose from our website. GameFlame does not provide any kind of warranty, or guarantee of any game, or return service; and after the purchase, GameFlame is not responsible for any problems found in the game.

CONTENT ON THE SITE

On our website we have some hyperlinks that may lead to other websites that are not owned or controlled by GameFlame. Such sites are provided solely as a convenience to you. GameFlame has has no control over the content of such sites. Connecting to linked sites and/or downloading any information from linked sites is done entirely at your own risk. GameFlame makes no representation or warranty that downloads from linked sites will meet any prescribed specification, nor do we make any representation or warranty that such linked sites will not contain viruses or otherwise impact your computer.

PRIVACY POLICY

Any information you submit to us, or any information we collect in connection with the GameFlame Services, is subject to the GameFlame Privacy Policy which is:

  • Anyone may browse our Websites, Products and/or Services, but you must provide personal information in order to register with us and take full advantage of all services and features that the GameFlame Websites, Services and/or Products have to offer.

  • By providing us your personal information you agree that we may contact you by email or SMS text.

  • When you visit or use GameFlame, we set cookies on your Web browser so that we can recognize you and personalize our site to your preferences.
